摘　　要：医疗救助权利作为社会权利之一,在国际公约、我国宪法和我国具体的行政法律、法规中均得到体现,我国的《社会救助暂行办法》还设专章规定了医疗救助制度。从法理、制度、规则和程序角度探析医疗救助的政府责任和公民权利,分析医疗救助权利实现的现实困局和理论难题,并从制度和程序上为医疗救助权利的实现提供支撑,明确政府责任、公民权利和义务、医疗救助权利的实现机制和规则,从而将医疗救助权利落到实处,完善我国社会保障体系。As one of the social rights, medical assistance right has been reflected in the international conventions, China's constitution and the specific administrative laws and regulations. Interim Measures for Social Assistance published in China has set up provisions of the medical assistance system. From the angle of legal principle, system, rules and procedures, the governmental responsibility and civil rights of medical assistance are both explored and the practical dilemma and theoretical problems of the realization from medical aids are analyzed and meanwhile the realization of the medical assistance right is provided support in both system and procedure. The governmental responsibility, civil rights and obligations, and the realization mechanism and rules of medical assistance right are furthermore determined. Thus the medical assistance rights fall into place and the social security system is improved in China.
