摘　　要：就其本质而言,中国古代伦理司法哲学是由其伦理法哲学所决定,并为其伦理政治所服务的。在这个意义上,中国古代以德刑关系为基本内核的伦理司法哲学基本上可以归诸其伦理政治哲学应用之范畴。从明德慎刑到德主刑辅,从德本刑用到明刑弼教,都是在政治统摄司法的条件下,而成为其时之司法哲学的。由此所衍生的亲亲容隐、恤刑慎罚、振冤恤滞、则天重伦等具体制度,既是伦理司法的表现形式,也是伦理政治的通达渠道。鉴于其伦理政治的固有价值取向,反暴政、反酷刑、重人伦、尚和谐成为中国古代伦理司法的主流价值。时至今日,这种价值取向仍然具有现实意义,其积极因素当为人民司法的现代转型有所汲取和借鉴。In essence,ancient Chinese ethical judicial philosophy is determined by its ethical law philosophy and serves its ethical politics. The ancient Chinese ethical judicial philosophy with the morality-punishment relationship as its base kernel can basically categorized as the application of its ethical political philosophy. Morality rule with prudent penalty,morality rule with punishment as a supplement,and integration of punishment with education are all the philosophies of the times under judicial conditions of political control. The systems deprived from these philosophies such as tolerance of kinship concealment,caution in applying punishment,and correction of unjust cases,are both the forms of ethical justice and access channels to ethical politics. Because of the ethical politics' intrinsic value,anti-tyranny,antitorture,emphasizing human relations and harmony are the main values of ancient Chinese ethical justice. Today these values still have some practical significance;their positive elements can be useful for the modern transformation of the people's judicature.
