行政法学的新使命——2016年行政法学研究述评

摘　　要：2016年,行政法学界围绕行政法基础理论、行政程序立法等问题,产生了一批优秀的研究成果,对促进行政法学理论发展、推动法治政府建设、实现国家治理能力和治理体系现代化,具有理论意义和实践意义。2016年行政法学研究呈现出三个特征:第一,选题紧密结合法治实践,为推进依法治国进程、法治政府建设提供了理论支持。第二,案例研究方法的运用明显增多,反映出大数据时代行政法学研究方法的变化。第三,理论研究不断深化,促进了理论创新与繁荣发展。In2016,Chinese academic circle of administrative jurisprudence produced a number of excellent research results around the issues of the basic theory of administrative law,the legislation of administrative procedure,etc.,which is of great theoretical and practical significance to promote the theoretical development of administrative jurisprudence and the construction of law-based government under the rule of law,and to realize the modernization of national governance systems and governance capacity.The study on administrative jurisprudence in this year was characterized by three aspects:1)the selected topic or subject closely connected with the practice of rule of law,in support of the promotion of the process of governing the country by law and the construction of law-based government under the rule of law;2)the significantly increased application of case study method,an indication of the change of the research methodology of administrative jurisprudence on the background of the era of big data;3)the constant deepening of theoretical research promoting the theoretical innovation and its prosperity and development.Based on the social reality and focusing on the practice of rule of law,Chinese academic circle of administrative jurisprudence needs to strive to make new breakthroughs in the priority research areas for governing the country by law,and lead the institutional innovation with the theoretical innovation,the former which can also then promote the significant reforms.
