摘 要:中国特色社会主义法律体系于2010年如期形成,就地方性立法而言,应以经济纠纷事实为导向,细化实施性立法;以经济秩序重构为指向,加快回应性立法。以地方区域法治为方向,发挥自主性立法;通过习惯风俗入判、司法判决固化习俗、区域司法合作等三项原则,严格立法权限代理制度、建立法律冲突裁决制度、完善规范清理制度体系,建构司法型立法体制机制,从而实现立法"后体系时代"地方法治建设进程中公共契约精神的解放。充分适用中央立法授权,建立司法型立法模式,授权判决型规则产出,从立法供给侧改革,全面落实"科学立法"的内在要求。The socialist legal system with Chinese characteristics was formed in2010as scheduled.As far as local legislation is concerned,it should be based on the facts of economic disputes to refinethe implementary legislation;guided by the reconstruction of economic orders to accelerate responsivelegislation;directed by the regional legal system to improve its self-directed legislation as well.Followed bythe three principles of customs judgment,judicial judgment consolidating conventions and regional judicialcooperation,it is expected to strict the agency system of legislative authority,to set up the adjudication systemabout legal conflicts,to improve and normalize the reexamination system of existing laws and regulations as wellas to construct the judicial legislation systems and mechanism.Consequently,the liberation of public contractspirit in regional legal construction of"post legislative system era"can be realized.It is supposed to fully applythe central legislative authority,to establish a judicial legislation pattern and to carry out the supply reform oflegislation to fully implement the inherent requirements of"scientific legislation"so that the improvement oflegal order can be promoted.
