对矿业权人勘查开采信息公示制度的几点思考

摘　　要：矿业权人勘查开采信息公示制度主要内容包括矿业权人应定期填报年度勘查开采信息并公示、矿业权人公示信息将随机摇号抽查、矿业权人未如期公示信息或信息不实将入"黑名单"等。在实际调查研究基础上,结合2016年黑龙江、浙江、湖北三省试点经验及实践中存在的问题,对公示制度的完善与实施提出以下几点思考:(1)在规定的5%抽取比例基础上,适当扩大抽查比例,增强责任落实到人,保证数据真实有效;(2)管理机关应积极主动推进,强化信用约束,创建社会共治的信用监管环境;(3)加强对中介机构监管,规范实地核查程序和行为。The information disclosure system of mining rights holders’exploration and mining mainly include that they should regularly fill the annual survey,open the information and accept random spot checks.Besides,the mining rights holders will be blacklisted if they do not open the information as scheduled or the information is not real.Based on the actual investigation,combined with the pilot experience and problems of Heilongjiang,Zhejiang and Hubei provinces in2016,the following points are put forward to perfect and implement the publicity system.Firstly,on the basis of the prescribed5%extraction ratio,expand appropriately the proportion of sampling and enhance the responsibility of executors to ensure the authenticity and efficiency of the data.Secondly,the administrative organization should actively promote the publicity system,strengthen the credit constraints and create a credit regulatory environment for social co-governance.Thirdly,strengthen the supervision of intermediaries,and regulate the procedures and behavior of field verification.
