摘　　要：通过对全国43个城市的国有土地上房屋征收补偿现状进行调查,在征收补偿、征收补助、征收奖励等方面,分析目前调研城市中征收补偿存在的不足,为构建房屋征收补偿的应然构成框架提供参考。研究表明:目前房屋征收补偿面临以下3个方面的问题:(1)房屋征收补偿的设置名目不一;(2)房屋征收补偿的设置标准不一;(3)房屋征收补助、奖励欠合理。研究结论:应从立法方面完善,因地制宜、科学合理制定征收补偿、补助、奖励的标准,并将信息化手段应用于征收管理系统当中,以完善目前征收与补偿工作中的不足。This paper analyzes the current situation of the collection and compensation of the43cities in China,and analyzes the existing problems of the compensation in the research cities.Whichprovides a reference for constructing the frame of housing compensation.The research shows thatthere are three problems following are faced by the compensation of house levy:(1)The compensationof house acquisition set different categories;(2)The compensation of house acquisition setdifferent standards.(3)Housing levy subsidies and incentives are unreasonable.The conclusion of thestudy is as follows:it is necessary to perfect the legislation and make the compensation standardscientifically and rationally according to the local conditions,and apply the information technologyto the collection management system so as to consummate the deficiencies in the current collectionand compensation work.
