社区矫正之目的向度研究——对《社区矫正法(征求意见稿)》第一条的修正

摘　　要：国务院法制办于2016年12月发布的《社区矫正法(征求意见稿)》第一条虽然规定了社区矫正的目的,但是其目的对象表述不清、目的内容涵盖不明,使社区矫正立法的基本方向存在一定偏差。刑罚执行是定罪量刑的延伸,刑罚执行目的是刑罚目的之延展。刑罚目的学说林立,我国应提倡报应和预防相结合的二元目的说,为社区矫正多元目的向度提供论理基础。社区矫正目的性质向度应附和刑罚目的,主张报应和综合预防;社区矫正目的层次向度应坚持双层次划分,实现罪犯罚矫向一般预防的层次递进。In December2016,the Legislative Affairs Office of the State Council released theCommunity Corrections(the Draft Containing Solicit Opinions)Article I.Although the corrections haveprescribed the target of Community Correction,its object and content covering are unclear,which more orless deviate the basic direction of Community Corrections.Penalty execution is the extension ofconviction and punishment,while penalty execution’s target is the extension of penal teleology.As thepenal teleology theories are numerous,China should promote the retribution and prevent the combinationof duality teleology,providing theoretical bases for the multiple target dimension of CommunityCorrection.The target dimension on quality of Community Correction should accord to the penalteleology and advocate retribution and integrated prevention.Whereas the target dimension on stages ofCommunity Correction should insist on the double division and achieve the hierarchy progress frompunishment and correction of criminals to general prevention.
