民间融资市场治理中的政府定位与制度建构

摘　　要：从理论上说,政府在民间融资市场治理中的定位是促进融资主体、行业组织和商业银行等治理功能的发挥。我国政府在民间融资市场治理中存在异位现象,无法有效促进其他主体发挥市场治理的功能。这与法律对政府权力约束不够相关,也与法律对其他市场治理主体的权利保障不力相关。促进政府角色回归需要在制度上加强权利保障和权力约束,并以此理顺政府与其他民间融资市场治理主体的关系。Theoretically,the government positioning in the market-governance of folk financing is to promote the governance function of financing subject,industrial organization and commercial bank.There is a phenomenon of malposition in China’s government in its market-governance of folk financing,which is unable to promote that other subjects give play to the function of market-governance effectively.This is relevant not only to the insufficiency of the constraint on government power by law,but also to the incompetence of the guarantee to the rights of other market-governance subject by law.It is required that the right guarantee and the power constraint should be strengthened institutionally to promote the return of the role of government,according to which the relationship between government and other market-governance subjects should be also straightened out.
