论《联合国反腐败公约》与我国最新刑事立法的衔接

摘　　要：近年,我国政府惩治腐败取得明显成效,刑事立法也及时跟进,具体表现为:完善贪污贿赂犯罪的定罪量刑标准,加大对行贿罪的处罚力度,增设对有影响力的人行贿罪,规定重特大贪污贿赂犯罪之死缓犯的终身监禁制度等。惩治贪污贿赂犯罪不仅需要国内立法的及时调整,也需要借鉴国外的成熟做法和成功经验。《联合国反腐败公约》是国际社会惩治腐败犯罪最为完整和全面的国际法律文件。研究该公约与我国刑事立法的衔接问题,对我国建立健全惩治和预防腐败体系有着重要的促进作用,具体可从以下几个方面着手:审慎适用死刑立即执行,适度扩大终身监禁的适用范围,构建公职人员廉洁信息和情报监督制度,加强与国际组织的协作。In recent years,the Chinese Government has achieved remarkable results to punish corruption,and the relevant criminal provisions of corruption are revised timely.The specific legislative changes include thefollowing contents:perfecting the standard of conviction and sentencing for corruption and bribery;increasingthe punishment of bribery;adding“the Crime of Offering Bribery to Influential Persons”and setting up lifeimprisonment system(without commutation and parole)for the criminals of serious corruption and bribery whoare sentenced to death penalty with reprieve of two years.The punishment against crimes of corruption andbribery not only depends on the domestic legislation amendment,but also needs to learn from foreign maturelegal experience.United Nations Convention against Corruption is the most comprehensive international legaldocument for punishment against corruption in the world.The research on the legislative connection betweenUNCAC and China’s criminal legislation will promote the establishment and improvement of a sound system topunish and prevent corruption.The four contents include:applying death penalty cautiously,expanding of theapplication of life imprisonment(without commutation and parole)properly,strengthening the cooperation withinternational organization and constructing the supervision system of public officials’integrity information.
