摘　　要：专利申请、专利使用许可、知识产权保护和其他知识产权交易市场是企业创新和全球化战略的重要手段,效率是知识产权市场持续发展的决定性因素,由于知识产权的地域性和法律不透明,知识产权交易成本高昂,损害了跨境知识产权的交易价值。而跨境知识产权民间规范可以避开与强行法冲突,增强交易透明度,降低交易成本,降低创新市场法律风险。Patent application,patent licensing,the protection of IP rights and other IP rights trading market are important means of enterprise innovation and globalization strategy.Efficiency is a decisive factor for the sustainable development of IP market.Because of the IP rights territoriality and opaque,IP rights transaction costs high,damages the cross-border IP transaction value.While private international transactional IP Rules can avoid conflict with mandatory rules,enhance the transparency of transactions,lower transaction costs,and reduce the innovation market legal risk.
