摘　　要：区域性大气污染对跨区域环境管理提出挑战,我国现有立法已到达瓶颈期,难以突破。国家层面的立法具有一般性,适用区域效果不佳,地方层面的立法易导致立法割据局面,而国内的区域环境协作又缺乏"协调型"法律来制衡。由此,提出新的立法模式,即协议立法。它是国家层面立法与地方层面立法之间的过渡,将私法精神融入公法管理,肯定行政权力与契约关系的结合,是解决区域环境管理无法有效统一的另一新途径。The regional air pollution brought new challenges to the management of the regional environment.The existing legislation has reached the bottleneck period and it is difficult to break through.National legislation is general and has little effect in different regions.The local legislation leads to the legislation regime,and the regional environmental cooperation of domestic lacks a"coordinated"law to check and balance.So it provided a new legislative mode,as Agreement Legislation.The agreement legislation is the transition between the national and local legislation,it melts the private law and public management,and it is certainly the combination of the administrative power and contract.The agreement legislation is a new way to solve the problem of regional environment management can't effectively unified.
