摘　　要：婚姻治理是陕甘宁边区基层社会治理的一项重要内容,体现了边区政策法令与乡村传统习俗间的碰撞、妥协与融合。面对革命情势、普世价值与传统社会的冲突与张力,边区政府一方面通过颁布系列婚姻法令,对婚约制度进行立法设计;另一方面,通过灵活的司法审判活动,对传统的"婚约""早婚""彩礼"等婚姻习俗进行有节、有度地改造。边区对婚约习俗的法律治理,体现出服务抗战、权衡利益、因地制宜、循序渐进等特点。边区婚约习俗的治理经验,为当下婚姻家庭法律制度改革乃至基层社会治理提供了镜鉴。The marriage governance was an important task of the local society governance in the ShensiKansuNingsia Border Region,which reflected the clash,compromise and fusion between the policies,laws and the rural traditional customs.Faced by the clash and tension between the revolution situation,the universal values and the traditional society,the border region government,on the one hand,passed a series of marriage statutes to establish the engagement system in law.On the other hand,the government regulated and changed some of the marriage customs such as the engagement,early marriage and the betrothal gifts through the flexible adjudgement gradually and modestly.The way of the law and governance in the marriage customs of this area reflected the characters such as serving the war of resistance against Japan,balancing different interests,consideration of local conditions and making steady progress.These governance experiences provide a historical mirror for the reform of the matrimonial and family law,even for the governance of the grassroots society.
