用法律之光照向无处安放的善良——从“见危不救”到“见危能救”之法律保障

摘　　要：民法总则中将鼓励见义勇为等行为写入,体现了国家和社会对见义勇为等行为的关注。"见义勇为"是一种美德,但同时,也可能是一种危险。在"彭宇"案后,人们的善良被社会的恶意侵蚀,在面对"见危能救"的现象面前往往选择了"见危不救",这是社会的悲哀,也是社会的无奈。针对这种现象,应从道德和法律的角度同时着手,加强道德法律化和法律道德化建设,将一些道德规范引入法律,实现道德法律化,其后,再促进法律道德化,从而使人们内心的善意得到法律保障,在遇到需要帮助别人的情形时,能够在自己力所能及的范围内进行施救,在弘扬良好社会风气的同时,进而推动法治社会的和谐发展。The General Principles of Civil Law(draft)encourages the writing of acts of courage and so on,which reflects the concern of the state and society about acts of courageous conduct."Courageousness"is a virtue,but at the same time,it may be a danger.In the"Peng Yu"case,people's kindness is eroded by the social malicious.In the face of"see the crisis to save",the phenomenon often choose the"see no danger",which is social sorrow,but also social helpless.In view of this phenomenon,we should proceed from the moral and legal point of view,strengthen the legalization of morality and the construction of legal morality.Besides,we should introduce some moral norms into the law,realize the legalization of morality,and then promote the moralization of the law and good faith to get legal protection.In the face of the need to help others in the case,we should be able to do whatever we can within the rescue in promoting a good social atmosphere at the same time,and thus promote the harmonious development of the rule of law society.
