浅论高校学生处分权与受教育权的平衡

摘　　要：高校学生处分权是高等学校自主管理权的组成部分,它的行使直接关系到学生的切身利益,甚至是关系到学生受教育权的实现。近年来,大量高校学生诉母校不当处分案的出现,引发社会的广泛关注,掀起高校学生处分权与受教育权讨论的高潮。本文从高校学生处分权性质入手,分析二者冲突的原因,提出相应的解决对策,以实现两者利益的平衡。College Students'disposition is part of autonomous management of higher school right,its exercise is directly related to the vital interests of students,and even influence the realization of the right to education of students.In recent years,college students sued the improper punishment case emerged,reflects the conflict of college student's right of disposition and the right to education in the intensified.Right of disposition of college students,analysis of the causes of the conflict between the two,and put forward the corresponding countermeasures,in order to achieve the balance of interests.
