竞争政策视域下我国外商投资准入制度的变革——兼论自贸试验区外资准入负面清单模式

摘　　要：在全球经济新格局中,中国不仅是国际投资规则的遵从者,更要成为规则的制定者。在外商投资准入制度中开放与风险并存,因此有必要"冷静思考"自贸试验区负面清单模式的借鉴意义。对内要通过实施自贸试验区战略、深化外商投资准入制度改革;对外则要积极参与多边与双边谈判,重视服务贸易和投资规则。具体建议是:以制定《外国投资法》为契机,完善全国适用的市场准入负面清单和配套的行政体制优化措施,提升我国外商投资准入法治化水平。在此基础上,利用商事制度改革的"单一窗口平台",完善负面清单模式下的外商投资并购审查、国家安全审查以及公平竞争审查制度的内在协调。在外商投资的准入环节更要实现贸易自由、市场公平、竞争中立,从而推动建设我国更高层次的开放型经济体制。In the new pattern of global economy,China is not only the compliance of international investment rules,but also the makers of rules.In the foreign investment access system,opening and risk coexist,so'is necessary to“think calmly”of the negative list model in Pilot FreeTrade Zone.Specific suggestions are as follows:referring to the pilot experience of foreign investment access system in China^s Free Trade Zone,establishing the priority of competition policy,taking Foreign Investment Law as an opportunity,improving the negative list of market access and supporting administrative system optimization measures,to promote the legalization level of foreign investment access in China.Based on this,using the“single window platform”of commercial system reform,improve the internal coordination of foreign investment merger review,national security review and fair competition examination system under the negative list mode.In the access link of foreign investment,we should realize free trade,fair market and competitive neutrality,so as to promote the construction of a higher level of open economic system in our country.
