摘　　要：体育赛事网络转播权是一项新型权利,其内涵、权利性质、与相关权利的界限仍存在争议。我国《著作权法》对网络转播权属性界定模糊,出现司法裁判中针对同一侵权行为作不同的判决。通过案例分析、比较分析和逻辑分析方法,从广播组织范围的扩大、明确转播行为性质,完善我国《著作权法》的相关立法,解决日益泛滥的网络转播权侵权的问题。As a new kind of right,the rebroadcasting right to sporting events to the public over network are still controversial issue in the legal theory and the judicial practices,especially about the intention,the nature and the boundary between other related rights.In this case,there are many different court dicisions for the same acts of infringement.But the Copyright Law of China is not clear about the definition to the rebroadcasting right to the public over network.Here through the comparative analysis of the cases,this paper points out that the amendments the Copyright Law should be required to address those problems,such as to extend interpretation for the broadcasting organizations,to define clearly the broadcast behaviors.
