摘 要:我国正在进行水流产权确权试点,确权路径是关键问题之一。提出了在防洪法和河长制规定的河湖管理范围基础上确定水流空间范围的想法,明确了水流所有权的边界和水流所有权人的权利,指出了市场在水流自然资源高效配置中的决定性作用,根据科斯定律得到了"水流产权界定是市场交易必要的先决条件"等结论。同时,明确了界定水流的所有权、使用权、收益权、转让权是我国水流产权确权的主要内容,其中清楚界定水流使用权、收益权和转让权是我国水流产权确权的关键内容。从我国目前的法规文件中找到了我国水流产权确权路径是"依据行政许可的原则确定",并且探讨了我国水流使用权、转让权等权利的具体确权路径。During the implementation of pilot project for confirming property right of water flow in China,the key issue is to find the route for property right confirmation.It is proposed to confirm the scope of flow space based on the scope of river or lake stipulated by Flood Control Law and River Chief System,so that the boundary of water flow andproperty right of the owner can be specified.The decisive role of market in effective allocation of water flow is discussed.It is concluded that野confirmation of property right of water flow is the precondition for its trading in the market冶,according to the Coase Theorem.The main contents of confirmation of property right of water flow are clarified,including ownership,utilization right,rights to earnings and assignment right.It is found that,according tothe current legal documents in China,the route of property right confirmation should be野principles confirmed in accordance with administrative permission冶.Discussions are also made on the specific routes and solutions for confirming property right of water flow and its assignment in China.
