摘 要:矿业权招标制度主要按照公告公示、评标和定标、公示结果和签署出让合同的程序进行,在决定招标程序的胜出者时,相对于价格评价标准,综合性竞得标准融合了其它各项因素的要求,兼具了两类标准的优点,因而在现行的公共资源交易中,被更多地采用。综合竞得标准的主要权重考评因素有商务条件、技术条件、不良行为条件。完善我国矿业权招标竞得标准的建议:(1)进一步完善招标制度的程序;(2)多样化评标议标的权重评价标准;(3)建立竞买人信用积分体系;(4)尝试和推广联合体投标模式;(5)完善矿业权出让后的跟踪监督制度。The public announcement,evaluation and selection,publishing bidding results and signing transfer contract is a line of the tendering system of mining rights.The requirements of other factors are integrated in comprehensive competitive standard,then what is used more commonly than price evaluation standard in currently public resources transactions for the bidding victors.Commercial conditions,technical conditions and deviant behavior conditions are the weight of primary factors in comprehensive competitive standard.This paper gives such suggestions for improving competitive bidding standard of mining rights transfer:perfecting the procedures of bidding system,diversifying the weight evaluation standard of bid assessment and bid negotiation,establishing a credit score system for bidders,promoting the consortium bidding model,improving the tracking supervision system of mining rights transfer.
