摘　　要：笔者通过对学界不同学说的概念分析与评价,得出对紧急避险概念的较为准确、合理的界定。并且通过研究理论界的三种学说,逐一分析其中利弊与合理性来确定紧急避险的性质归属。紧急避险制度虽然并非刑法的新领域,但仍存在较大的发展空间与完善之处,所以对于这一重要的制度应当不断完善。Through the analysis and evaluation of the concept of different scholars,the author gets a more accurate and reasonable definition of the concept of emergency avoidance.Through the study of the three theories,and one by one to analyze the pros and cons and rationality to determine the nature of emergency avoidance.Although the system of emergency avoidance is not a new field of criminal law,there is still room for further development and improvement.
