公安边防部门“三非”外国人管理法律问题研究

摘　　要：当前,外国人非法入境、非法居留、非法就业现象日益突出,以部分周边国家人员为主的"三非"外国人数量逐年增长,并由我国沿边沿海地区向内地扩散,对公安边防管理的影响越来越大。针对公安边防部门"三非"外国人管理工作存在的执法依据内容滞后、处罚力度偏轻、执法效率低、打击处理难等问题,提出完善法律依据、加大执法力度、加强执法建设、完善执法合作的应对措施。Nowadays,there are more and more foreigners engaging in illegal entry,illegal residence and illegal employment in China.With the number of foreigners engaging in these illegal activities increasing and this phenomenon spreading from coastal areas to the inland,its impact on border management is becoming bigger and bigger.There are some problems concerning border control department’s management of foreigners engaging in“three kinds of illegal activities”,such as the outdated legal basis of law enforcement,light punishment,low efficiency of law enforcement,difficulty in cracking down.To solve these problems,this paper puts forward suggestions of consummating legal basis,intensifying law enforcement,strengthening the construction of law enforcement,and perfecting the law enforcement cooperation.
