民法典婚姻家庭编瑕疵婚姻制度的立法建议——以《民法总则》之瑕疵民事法律行为制度在婚姻家庭编中的适用为视角

摘　　要：婚姻家庭编中瑕疵婚姻的制度设计应兼顾民事法律行为制度的体系性和结婚行为作为身份行为的特殊性,民法总则中的瑕疵民事法律行为制度应以是否有悖于身份行为的特质为标准予以有选择的适用。瑕疵婚姻的类型除了应维持目前效力瑕疵上的双轨制之外,还应增设婚姻的不成立制度。无效和可撤销婚姻的,事由上应当以《民法总则》的规定为依据并结合结婚行为的特性加以确定和解释;在婚姻无效和被撤销的后果上,应取消可撤销婚姻具有溯及力的规定,增设婚姻瑕疵的治愈事由,增设无效婚姻和可撤销婚姻中善意一方以及无过失一方当事人的救济制度。The institutional design of the flawed marriage in the marriage and family law should consider both the system of the civil juristic act of civil law and the particularity of marriage.The application of the system of defective civil juristic act in the marriage and family law should be based on whether it is contrary to the characteristic of the identity act.The kinds of flawed marriage include ineffective marriage,invalid marriageand voidable marriage.The reasons for the invalid or voidable marriage shall be determined and explained in the light of the provisions of the“General Rules of the Civil Law”and the characteristics of the act of marriage;therevocable marriage should not have retroactive effect;the system of the cure of marital flaws and the systems of relieving for the good faith and innocent parties.
