摘　　要：在行政转型的语境下,政府法律顾问扮演着多重角色。欲使顾问律师实现其应有角色价值,就必须厘清顾问律师在法治政府建设中的角色误区,明确政府法律顾问的角色定位。顾问律师既非责任主体的"替代者",也非首长命令的"装饰者",更不是行政机关的"使役者"。相反地,政府法律顾问参与法治政府建设,既是助援,亦为制约。顾问律师应当是法治政府建设的参与者、规约者、服务者。与之相应,顾问律师应当坚持的取向是行政民主、行政法治、行政正义。In the context of administrative transformation,government legal advisers play a multiple role.To make the consultant lawyers to achieve their role value,it must clarify the misunderstanding of their role in the Construction of Law-based Government,and specify the role of government legal adviser positioning.The government legal adviser is neither the"substitute"of the subject of responsibility nor the"decorator"of the chief command,nor the"servant"of the executive.On the contrary,the government legal adviser is involved in the construction of the government under the rule of law.It is both aid and control.The adviser should be the participant,the contractor,the servicer.Accordingly,the lawyer should adhere to the administrative democracy,administrative legality and administrative justice.
