独立担保欺诈例外原则的司法适用问题研究

摘　　要：欺诈例外原则作为独立担保独立性的例外,弥补了独立担保的固有缺陷,能够有效防止受益人欺诈的风险。而欺诈例外原则的司法适用关系到独立担保的独立性价值的实现和当事人合法权益的保障,对独立担保功能的有效发挥尤为重要。法院对独立担保欺诈具体情形的认定、法院对基础交易的审查限度、法院适用欺诈例外原则的证据要求是独立担保欺诈例外原则司法适用的三个核心问题。我国颁布的《最高人民法院关于审理独立保函纠纷案件若干问题的规定》中对这三个问题作出了指导性规定,但通过对有关的国际规则和主要国家的司法实践进行比较研究,该司法解释尚存在一定的完善空间。The fraud exception principle,as an exception to independence characteristics of independent guarantee,makes up for the inherent defect of independent guarantee,which can effectively prevent the risk of beneficiaries’fraud.The judicial application of fraud exception principle is related to the realization of the independent value of independent guarantee and the protection of the legitimate rights and interests of the parties,which is very important for the efficiency of independent guarantee.The court’s determination of specific circumstances of fraud,the court’s review limit of underlying transaction and the evidence requirements for the application of fraud exception principle by court are three key issues of judicial application of fraud exception principle of independent guarantee.The Provisions of the Supreme People’s Court on Several Issues Concerning the Trial of Dispute Cases of Independent Guarantee provide guiding rules about these issues.However,compared with international rule and judicial practice of other countries,the judicial interpretation still has some space for improvement.
