摘 要:物业服务合同与委托合同、承揽合同均存在显著区别,因此其并非合同法意义上的典型合同。物业服务在内容上具有复合性和多样性,物业服务是否存在瑕疵应区分服务内容和性质加以具体判断。档案资料保管义务、维修义务、保洁义务等属于结果债务,而保安义务则是典型的手段义务,即使发生盗取、抢劫等损害事故,也不能据此认定物业服务人履行保安义务存在瑕疵。法释[2009]8号第3条未区分物业服务不完全给付的类型,直接赋予单个业主违约请求权值的检讨。对于瑕疵给付,单个业主并非适格当事人,其不能以自己名义追究物业服务人的违约责任。There is a significant difference among realty service contract,entrustment contract and hired work contract,thus realty service is not a typical contract in the sense of contract law.Realty services are compounded and diverse in content.The realty service enterprise shall provide corresponding services according to the agreement in the contract for realty services.When the realty service enterprise fails to fulfill the agreement in the contract for realty services,it may cause damage to the personal safety and property safety of the proprietors,it shall bear corresponding legal liability in accordance with law.Article 3 Interpretation of the Supreme People's Court on Issues Concerning the Specific Application of Law in the Hearing of Cases Involving Disputes over Property Services didn't distinguish the types of default,so the article is worth reviewing.
