依法治国与依规治党统筹推进机制研究——基于中国特色社会主义法治的动态分析

摘　　要：依法治国与依规治党是中国特色社会主义法治的两大基石,目前学术界对两者统筹推进的动态分析主要从立法和执法两个法治环节展开,改进该研究需要进一步从完整的法治过程分析出发,将依法治国与依规治党统筹推进全面贯穿于立法、执法、司法和守法这四个前后衔接的法治过程。构建依法治国与依规治党统筹推进机制,需要以党组制度、党政机关联合发文制度、领导小组制度等政治制度为支撑,健全中国共产党"领导立法、保证执法、支持司法、带头守法"的一系列机制,在法治运行过程中着力构建政党立规与国家立法统筹推进机制、政党执规与国家执法统筹推进机制、党内问责与司法机关法律问责统筹推进机制、党员守规和全民守法统筹推进机制。The Rule of Law and Regulations-based Governance of the Party are the two cornerstones of the Socialist Rule of Law with Chinese Characteristics.To date,the dynamic analysis of the integrating development of both in the academic circles mainly focuses on the links of law legislation and enforcement.Aiming at improving the research,we need start from further analyzing the rule of law process completely,and carry the integrating development of the Rule of Law and Regulations-based Governance of the Party through the four process of continuity,namely legislation,law enforcement,administration of justice and law-abiding.The construction of overall promotion mechanism of Rule of Law and rules-based governance of the Party requires the support of various political systems,including the Leading Party Group System,Party and Government Organs Jointly Mandate System and System of Leading Group.At the same time,we shall enhance a series of mechanisms of the Chinese Communist Party regarding the“Lead the legislation,Ensure law enforcement,Provide judicial support,Take the lead to obey the law”.In addition,in the operation process of the rule of law,we should emphatically build the overall promotion mechanism of Party promulgation of regulations and national legislation,the mechanism to balance the development of Party regulations enforcement and legislation of state organs,the overall promotion mechanism of accountability in the Party and accountability by law of judicial organs,and overall promotion mechanism of Party members regulations-obeying and the law-abiding of the entire people.
