我国“法治社会”构成要件探析

摘　　要：法治社会是良好的法律在一定区域得到切实执行和遵守的持续性活动过程及其呈现出的态势。在我国,建设法治社会首先要明确法治社会的基本概念和构成要件,从而准确定位社会法治发展所处的阶段并做出相应规划。通过对当前各种观点的归纳、比较以及对法治活动逻辑关系的分析,可以得出法治社会的三个基本构成要件,即良法、良法得到切实执行和遵守以及司法独立。除此之外,我国社会主义法治社会构成要件还须具备"执政党守法"之特殊要件。A society ruled by law is a continuous process and status where good law is implemented effectively in certain area.In China,the construction of a society ruled by law requires definite definition of basic concepts and constitutive elements of a society ruled by law,thus we can accurately locate the stage of development of the society and make corresponding plans accordingly.In this article,three elements are abstracted by means of analyzing and comparison of the current views,as well as the logical relationship among the elements,namely good law,adequate implementation and strict observation,and judicial independence.In addition,the ruling party is also required to abide by law in the construction of a socialist legal society.
