刑事个案犯罪信息研判中的选言三段论和摸排方法

摘　　要：刑事个案犯罪信息研判是指侦查人员在刑事个案侦查中,对某一刑事个案的现有犯罪信息进行分析研究,得出关于犯罪信息新判断的思维过程,它以推理为主要信息处理方式。选言三段论是刑事个案犯罪信息研判中的一种常用推理,它以选言判断作为前提之一,以该选言判断的一部分选言支的肯定或者否定作为另一前提,以该选言判断的剩余选言支的否定或者剩余选言支中至少一个的肯定作为结论。选言三段论在刑事个案犯罪信息研判中的典型运用就是摸排方法。基于刑事个案犯罪信息研判中选言三段论的缺点,在刑事个案犯罪信息研判中运用选言三段论时需要遵守一些合理性原则。Criminal case information research refers to the reasoning process in which investigators analyze the existing information of a case and form judgment on crime information by reasoning.Disjunctive syllogism is a commonly used reasoning method in criminal case information analysis,which takes disjunctive judgment as its premise,approval or disavowal to some part of the disjunctive syllogism judgment as another premise,and approval or disavowal to the rest of the disjunctive syllogism as the conclusion.The typical application of syllogism in criminal information analysis is through thorough search.Based on the shortcomings of the syllogism in criminal case crime information adjudication,some principles of rationality should be observed.
