2例交通事故真假“碰瓷”敲诈案的法医学鉴定

摘　　要：目的探讨如何在司法鉴定中区分交通事故所致骨折损伤中的真假"碰瓷"敲诈案。方法对2例"碰瓷"敲诈案的案情、临床症状与体征、影像学材料及法医学检查进行客观分析,通过影像学材料结合初诊时的临床症状来区别新旧骨折,进行交通事故因果关系和伤残等级鉴定,区分真假"碰瓷"敲诈案。结果 2例"碰瓷"案中,真"碰瓷"案1例,交通事故与个体左侧下肢骨折无直接因果关系;假"碰瓷"案1例,个体右胫骨再次骨折虽不构成伤残等级,但交通事故与个体右胫骨再次骨折之间存在直接因果关系。结论影像学材料是辨别真假"碰瓷"的关键因素,但确定是否为"碰瓷"敲诈案一定要结合案情、临床症状体征及法医学检查。Objective To discuss how to identify the fracture differences between true“Pengci”extortive cases and the fake ones of traffic accident in forensic identification. Methods The details of two“Pengci”cases were analyzed by clinical symptoms and physical signs of the injury,imaging materials and forensic examination results.New and old fractures can be distinguished by analyzing the imaging materials and preliminary diagnosis,then the relationship between the wound and accident can be confirmed,and the disability grade can be identified.Therefore the true and fake extortive cases can be distinguished. Results In the two cases,one is true“Pengci”,and the fracture on the left lower extremity has no correlation with the accident.Another is fake one,there was a direct relationship between a traffic accident and the individual’s fracture on the right lowe extremity though it can’t reach disability grade. Conclusion Imaging materials are the key factors to distinguish between true and fake“Pengci”cases.However,it is necessary to combine the case facts,clinical symptoms and signs,and forensic examinations to determine whether or not it is a“Pengci”blackmailing case.
