摘 要:购物评价系统便于消费者自主选择权及言论自由的充分行使。但是现在的评价系统存在着种种乱象不但导致经营者的商誉难以恢复或重新建立,而且其在商誉相关的开支也不得不提高。目前我国经济法对遏制不合理的恶意差评给商家带来的负面影响存在一定的不足之处,例如主体范围的狭窄、责任形式的单一,商誉保护方式的粗放等。此外就消费者是否应负担评价前与经营者协商维修、换货的前置义务的问题,需要从利益平衡角度深入思考。The shopping evaluation system is convenient to consumers'right to select on their own and the full exercise of freedom of expression.However,there are various chaos in the current evaluation system,which not only leads to the failure to restore or rebuild the goodwill of the operators,but also raises the related expenses in goodwill.At present,Chinese Economic Law has some shortcomings to curb the adverse effects of unreasonable malicious bad reviews,such as the narrow scope of the main body,the single form of responsibility,the extensive protection of goodwill.In addition,it is necessary to think deeply from the perspective of balance of interests on whether consumers should negotiate the preposition obligation of maintenance and exchange of goods before the evaluation should be paid to the operators.
