摘　　要：国际卡特尔是卡特尔的一种特殊形式,表现在它的影响范围不再限于本国内,而是会对两个或者两个以上国家的市场竞争秩序以及消费者的利益产生消极影响。在规制国际卡特尔中,我国法律没有明确作为罚款依据的销售额的范围;也没有将卡特尔成员的违法期间反映在罚款中。立足国际层面则是对同一个国际卡特尔存在重复、过度罚款现象,易导致市场势力较弱的卡特尔成员退出市场,损害市场及消费者利益。我国应当完善国内法律规定,同时应当密切与他国的国际合作。International cartels,a special form of cartel,show that its scope of influence is no longer limited to the territory,but will have a negative impact on the market competition order and the interests of consumers in two or more countries.In the regulation of international cartels,our law does not specify the scope of the sales as a basis for fines;at the same time,it does not reflect the duration of the cartels.At the international level,there is duplication and over-fines for the same international cartel,which will easily lead to weaker market forces from the market and harm the market and consumers.My country should improve its domestic laws and regulations and at the same time should closely follow the international cooperation with other countries.
