承包土地经营权抵押制度架构——基于安徽宿州市抵押模式探析

摘  要:我国农村土地结构从传统的二元结构转化为三权分置,使得承包土地经营权成为一种独创性的权利。2015年,安徽宿州埇桥区被授权开展经营权抵押制度,开展过程中进行了积极探索。宿州承包土地经营权制度推行过程中面临抵押物处置难等诸多问题,其也创造性的设计了反担保等措施进行助力。如今试点工作即将结束,应充分借鉴宿州市的经验并对其问题予以反思,完善顶层设计。China 's rural land structure has transformed into? the separation of three rights from the traditionaldual system,making contractual land 's management right be a unique right. In 2015,Yongqiao District of Suzhou City of Anhui Province was authorized to carry out the mortgage system of contractual land's management right,during which some problems appeared such as the difficulties in settling mortgage and so on,but it designed many creative measures like counter-guaranty to solve it. Now,the reform program is coming to an end,and the improvement of top-level design should learn lessons from Suzhou City and reflect its problems.
