“两淮”采煤沉陷区失地农民权益保障的探讨

摘　　要：安徽"两淮"地区是高潜水位典型沉陷区。采煤规模不断扩大和不合理开采导致大面积的土地沉陷,大量的失地农民随之出现。由于我国对采煤沉陷区失地农民的权益保障制度不够完善,使得失地农民"无地可种、无业可就、无保可享",成为了城乡边缘性群体,严重影响到农村社会稳定与经济发展。从权益保障的角度出发,结合淮南、淮北市的实际情况,以深度访谈和个案研究的方法,重点从农民土地补偿、拆迁安置及社会保障等方面,分析"两淮"采煤沉陷区失地农民权益受损现状、原因及其保障困境,进而以包容性发展理念为指导,提出切实保障"两淮"采煤沉陷区失地农民权益的对策和建议。The"lianghuai"area of Anhui is a typical subsidence area with high phreatic water level.The scale of coal mining continues to expand and irrational mining results in a large area of land subsidence,and a large number of landless farmers appear.Owing to the imperfect protection of the rights and interests of the landless farmers in the coal mining subsidence area,they"have no arable land,can not obtain employment and can not enjoy social security",and become a marginal group of cities and villages,seriously affect the social stability and economic development in rural areas.From the angle of rights and interests protection,combined with the actual situation of Huainan and Huaibei city,In depth interviews and case studies are used.This paper studies the focus of the farmers from land compensation,resettlement and social security,analysis of the"lianghuai"coal mining subsidence land lost farmers rights and interests,the status quo,the cause of damage to rights and interests and the plight of protection,guided by the idea of inclusive development.This paper puts forward some countermeasures and suggestions to ensure the rights and interests of landless peasants in"lianghuai"mining subsidence area.
