从行政逻辑到司法之维:法官会议制度的应然图景——由功能“弱化”与“异化”的样本说起

摘　　要：我国法官会议制度在审判实践中存在功能"弱化"与"异化"的双重困境:被"架空"致使咨询与统一裁判尺度的效果不理想,或被"滥用"异化成法院内部的审判决策组织。根源在于该制度运行背后行政化的异化逻辑,表现为组成机制、启动机制、发言机制的高度科层化以及会议决议影响独立裁判等。我国法官会议制度应转变会议运行理念,坚持效益原则,改造功能维度、规则维度和运行维度,推进审判权运行扁平化。The system of judge meeting in China has two dilemmas of function weakening and alienation intrial practice: eitiier being $ overiiead% ,the result of consultation and unified referee scale is not is $ alienated% into the court' s internal decision making organization. The mot lies in the dissimilation logicbehind the administration of tlie system. It shows the high level of tlie composition mechanism,the speech meciianism and the independent referee of the conference resolution. The meetingshould change the operation philosophy,adhere to the princif)le of efficiency,change the dimension of function,rules and operation and promote the flattening
