摘　　要：随着改革开放的深入以及社会主义市场经济的不断发展,我国的经济实力得到了空前的发展壮大。随着经济水平的不断提高,网络技术也取得了长足的进步。网络信息时代正在影响人们日常生活的各个方面,在这一过程中,人们的个人信息与个人数据在网络时代中已被人越来越多地了解。个人数据在网络中的存储以数据库为主要方式,数据库的开发与应用中,一个很大的问题就是对个人数据隐私权的保护。以个人数据为直接对象的数据库上存在着两种最为基本的权利:数据库权利以及数据主体的权利。对于前者而言,它的核心利益主要为财产利益。而对于后者来说,它的核心利益主要是人的尊严和人格的利益。这两者在数据库的开发与应用中经常会发生冲突,主要表现在数据库对个人敏感数据的非法采集和处理,以及个人数据被时刻监控。所以,数据库开发与应用中的隐私权限制问题日益重要。With the deepening of reform and opening up and the continuous reform of the socialist market economy,China's economic strength has been an unprecedented development and growth.With the continuous development of economic level,network technology has made great progress.Network information age is rapidly affecting people's daily life in all aspects,in this process,people's personal information and personal data in the Internet age has been more and more detailed understanding.Personal data is stored in the network as a primary means of database.A big problem with the development and application of databases is the protection of individual data privacy.There are two basic rights to database with direct data on personal data:the rights of the database and the rights of the data subject.For the former,its core interests are mainly property interests.For the latter,its core interests are mainly human dignity and personality interests.The two in the database development and application often conflict,mainly in the database of personal sensitive data on the illegal collection and processing,and personal data is being monitored at all times.Therefore,the issue of privacy restrictions in database development and application is becoming increasingly important.
