地方绿色建筑立法的完善路径

摘　　要：纵观绿色建筑的立法历程与当下概况,地方在绿色建筑方面既可以实施性立法,亦可进行创制性立法。绿色建筑具有因地制宜之特点,地方应当发挥自身作用,通过立法切实推进绿色建筑的发展事业,保护环境节约资源,改善公众居住条件。我国现行绿色建筑法律体系仍有不少疏漏,地方可以结合本地实际情况进行立法,以促进绿色建筑发展,为完善绿色建筑法律体系累积经验。宏观方面,绿色建筑的地方立法可在专门立法、建立健全法律体系方面有所作为;微观方面,在加强刺激性激励措施,制定绿色建筑强制性标准与强制性评价标准,规范政府部门监管,培育市场主体参与绿色建筑生产与消费活动等领域地方立法尚有进一步完善之空间。Looking at the process and the present condition of green building legislation,the local legislation can be implemented in the green building,as well as the creation of the legislation.Because green building has the characteristics of adjusting measures to local conditions,so the local government should legitimate to push the development of green building in order to protect environment and to save resources,improving public living conditions.Nowadays,there are still many defects in legal system of green building in our country,so the local government can legitimate according to the conditions to promote the development of green buildings and to accumulate experiences of the legal system of green building as well.On the macroscopic level,the local legislation of green buildings can make a difference in the special legislation and the establishment of a sound legal system.On the microcosmic level,there is room for further improving the local legislation in terms of stimulating incentive measures,formulating mandatory standards and mandatory evaluation standards for green buildings,standardizing supervision of government departments,and cultivating market participants in green building production and consumption activities.
