中国拒绝《国际水道非航行使用法公约》法理分析

摘　　要：1997年《国际水道非航行使用法公约》作为首个国家间跨界水资源合作全球性法律框架的国际公约已经生效。中国对该公约持反对态度,国际、国内社会对此颇有疑虑和非议。该公约存在各种缺陷和问题,且不符合中国的国家利益,目前中国不宜参加该公约。The Convention on Law of Non-navigational Uses of International Watercourses issued in 1997 as the first international convention on the global legal framework for the cooperation of transboundary water resources has entered into force.International and domestic society have doubts and criticism for China's opposition to the convention.The convention has all kinds of defects and problems,and does not meet China's national interests,so China should not participate in the Convention.
