摘　　要：为适应打击复杂多变的腐败犯罪的客观需要,切实履行《联合国反腐败公约》所确立的义务,《中华人民共和国刑法修正案(九)》(以下简称《刑九》)增加了对有影响力的人行贿罪。该罪客观方面表现为行为人为谋取不正当利益,向国家工作人员的近亲属、其他与该国家工作人员关系密切的人以及离职的国家工作人员等有影响力的人行贿的行为,侵犯的法益是国家工作人员职务行为的公正性和公众对职务行为公正性的信赖。认定对有影响力的人行贿罪,应当注意从相互之间的关系、社会地位、社会价值、社会公众对物品价值的一般观念等为标准来区分行贿犯罪与馈赠的界限,从是否具有利益要求等区分行贿犯罪与感情投资的界限。对有影响力的人行贿罪与行贿罪的界限主要在于犯罪对象不同,二者形成的对向性犯罪不同。In order to meet the objective needs of combating complex and volatile corruption crimes and perform the obligations established by the United Nations Convention Against Corruption,the crime of offering bribes to influential people was added in the Amendment of Criminal Law of the People’s Republic of China(nine).The objective aspect of this crime is people seek improper interests by offering bribes to the state personnel’s close relatives,others who are close to them and those ex-serving officials who are still influential.The legal interest it infringes is the impartiality of state functionaries’behaviors and the public trustworthiness in the state functionaries’behaviors.To affirm the crime of offering bribes to influential people,it should be noted the relationship between each other,like social status,social value and the public general idea of the value of goods as the standard to distinguish the boundaries of bribery crime and gift and to distinguish the boundaries of bribery crime and emotional investment from whether the interest requirements were made.The distinction between the crime of offering bribes to influential people and the crime of bribery lies in the different criminal objects and the different subtending of briber-offering and bribe-taking.
