我国贪官外逃现象及刑事追惩对策探讨

摘　　要：贪官外逃是指触犯我国贪污贿赂犯罪有关罪名的国家公职人员,为逃避我国的法律追究,从我国内地潜逃境外并且伴有资金外逃行为的现象。我国贪官外逃一度形势严峻,并且呈现出一定特征。刑事法律在追逃和惩治外逃贪官时要综合运用刑事政策、刑事程序和刑法规范,坚持宽严相济刑事政策,依法适用违法所得没收程序追缴外逃赃款,谨慎适用死刑,并且增加罚金刑的规制和适用。Absconding of corrupt officials is state functionaries who commit crime of corruption and bribery in our country,evade our country's legal prose-cution and abscond from the hinterland of our country to cross the borders and accompanied by the capital flight behavior.The current situation of absconding of corrupt officials is severe and it presents certain characteristics.Crimin-al law system should use criminal police,criminal procedure and criminal law standard in pursuit and punishing the fled corruptive officials.We should adhere to the lenient and severe criminal policy,apply to the forfeiture procedure of illegal income to recover flighting capital.Under the idea of the abolition of the death penalty,the death penalty should be applied cautiously,the regulation and application of fine penalty should be increased.
