网络“裸持”信贷中的犯罪及其刑法规制

摘　　要：通过分析"裸持"信贷中的犯罪现状,可知我国法律对裸持信贷规定存在不足。此类犯罪行为具有多样刑法性质和特定的犯罪规律。结合域外英美对信贷的立法、监管方面的规定,应当从刑法规制路径和社会制度层面的构建解决措施,完善规制裸持信贷的法律规制路径。By analyzing the status quo of crime in“naked”credit,it is seen that there is insufficient regulation in our country's law on“naked”credit.This kind of crime shows diversity and specificity of crime rules.By combining the extraterritorial rules of legislation and supervision of credit and putting forward the criminal law regulatory path and the social system level of the solution,the paper strives to gradually improve the regulation of online“naked”credit.
