摘 要:全球跨国资本流动日趋频繁,导致投资者与东道国的争端日益频发,投资者往往倾向于将争端提交到ICSID仲裁庭进行仲裁解决,同时ICSID仲裁庭亦通过各种手段以获取更多管辖权,如扩大"同意"的主体,扩大对"投资"与"直接"的解释,扩大对BIT相关条款的解释。对此,在"一带一路"背景下,为有效地维护权益,未来我国应做如下努力:对ICSID管辖权"同意"方式进行区分对待,对"投资"的定义进行明晰,明确MFN适用与不适用的具体事项,对运用保护伞条款予以限制,推动岔路口条款的适用。Global cross-border capital flows become increasingly frequent,which results in the disputes between investors and the host country.Investors tend to submit the disputes to the ICSID for arbitration,and ICSID arbitration tribunal could obtain more jurisdictions through a variety of means such as the subject expansion of consent and the expansion of investment and direct to interpret the relevant articles of BIT.In the Belt and Road Initiative background,China should do the following work to effectively safeguard people’s rights:to distinguish the way of agreement of ICSID jurisdiction,to clarify the definition of investment,to clarify the applicability of MFN specific issues,to restrict the umbrella clause,and to apply the crossing terms.
