终身监禁替代死刑之路径与实现——兼论四例终身监禁判决之妥适性

摘　　要：终身监禁对死刑立即执行的替代功能是其本位归属。但在替代效果的呈现上,却面临直接替代与间接替代分层之趋向,而终身监禁的间接替代的模式是一种重刑化的处遇方式,不仅与刑罚文明演进走向相背离,自身也面临诸多理论悖论,理应摒弃。在终身监禁的适用路径上,有递进式路径与收缩式路径之分,递进式路径式以间接替代模式为内核,四例终身监禁判决亦是此思维路径下的产物,对此,应当及时校正该终身监禁司法适用上的偏差,确立起以直接替代模式为主张的收缩式路径,以确保终身监禁死刑替代实现上的妥适性。Life imprisonment is an essential substitute for the immediate execution of the death penalty.However,there are two situations:direct substitution model and indirect substitution model.The indirect substitution mode of life imprisonment is a method of severe punishment,not only with the departure of the penalty civilization,its own also has many theoretical contradictions.We should abandon this indirect alternative model.There are two kinds of progressive path and contraction path in the application path of life imprisonment.The progressive path is centered on the indirect substitution model,which is also the guiding ideology of the current life imprisonment judgment.As to this,we should promptly correct the deviation of the legal application of life imprisonment,and reestablish a direct alternative model as the core of the contraction path.Only in this way can we guarantee the appropriateness of life imprisonment on the death penalty.
