摘  要:我国城市住宅商品化后,封闭住宅区已成为城市住宅的主要形式。封闭住宅区在具有保障小区内部安全、给业主提供便捷生活方式等优势的同时也带来了交通堵塞、社交活动障碍、公共资源浪费等诸多弊端。尽管封闭住宅区的开放,面临开放性与私密性、公权与私权、政策与法律等冲突,但开放封闭住宅区建造街区制住宅成为社会发展的要求,为此国务院出台了相关政策。在封闭住宅区的开放进程中,首当其冲要解决的是政策法律化问题,比较有效的方式是由国务院住建部颁布相关行政规章,为开放对象的确定、合适开放方式的选择、补偿方式的协商提供法律依据,做到有法可依,有效推进封闭住宅区开放。After the commercialization of China s urban residential,residential area has become the main form of urban residential.Closed residential area has the advantages of ensuring the safety of the community,providing convenience for the owners,but also brings a lot of drawbacks,such as traffic jams,social activities,public resources waste and so on.Although the open closed residential area,facing the openness and privacy,public and private rights,policy and law of conflict,but the open closed residential area building blocks for residential become the requirements of social development,the State Council issued relevant policies.In the process of opening up closed residential area,first is to solve the problem of legal policy,more effective way is promulgated the relevant administrative rules by the State Council of the Ministry of housing,open object,open the right way,compensation negotiation to provide legal basis,according to the law,effectively promote the open closed residential area.
