中国法律援助值班律师制度的发展及完善

摘　　要：我国的法律援助值班律师制度2006年以河南省为试点逐渐发展起来,现已成为中国特色社会主义法律援助制度的有机组成部分。然而在具体实施过程中,我国法律援助值班律师制度还存在顶层立法缺位、讯问成年犯罪嫌疑人时值班律师在场权无法实现以及值班律师定位尚未明确等问题。推动法律援助值班律师制度建设需要积极推动相关立法,确立讯问成年犯罪嫌疑人时值班律师的在场权,将法律援助值班律师的职能明确定位为"准辩护人",以此充分保障控辩平衡,切实保障犯罪嫌疑人、被告人的合法权益。The Duty council system of China starts in Henan province in 2006,and it is gradually becoming an important part of judicial relief system.However,in the process of development,the Duty council system faces some problems,for example,the legislation on this area is absent,the location of the Duty council system is not clear,etc.In order to solve these problems,this article offers some solutions,for example,to enhance the legislation on relevant fields,to establish the conception of defender,etc.These solutions can keep balance of the accuser and the defender,and protect the legal rights of the suspects or defendants.
