摘 要:WTO争端解决实践表明,反倾销反补贴同时适用"替代国标准"与"外部基准"因无法避免"重复救济"而不具有合法性和合理性。"双反"案件单独适用"替代国标准"与"外部基准"虽具有国际规则基础,但其公平性评判应根据个案区别不同情况进行具体分析。我国在应对当前欧盟修订反倾销法以及多哈回合反倾销、反补贴法修订谈判中对此应持有明确的立场。The practice of dispute settlement in WTO shows that“substitute country criterion”and“external benchmark”cannot be applied simultaneously in anti-dumping and countervailing cases,which are not legitimate and rational due to the inevitable influence of“double remedy”.They can be applied separately in both cases on the basis of international rules.However,their fairness should be judged according to the particular situations in different cases.China should adhere to the above principles in the negotiations with EU and Doha Round for revising the laws of anti-dumping and countervailing.
