摘 要:价格听证制度为民意的表达提供了有效渠道,但由于该制度尚且年轻,实践中仍存在诸多问题,尤其是作为制度核心环节的消费者代表遴选机制屡屡引发社会争议。文章从个案出发,结合当前立法发现遴选机制存在的问题:遴选方式缺乏公开性和科学性;报名、公告和送达材料时间短;消费者代表人数"比例低、范围窄",以及权利救济机制不完善。同时,针对问题分析原因,提出三点建议:完善消费者代表遴选规则;强化政府为民服务理念;充分发挥媒体事前宣传、事中监督和事后评价作用,旨在完善价格听证制度,尽量避免价格听证会与消费者利益背道而驰。The price hearing system provides an effective channel for the expression of public opinions.However,because the system is still young,there are still many problems in practice.Especially,the selection mechanism of consumers which is the core part of the system has repeatedly caused social disputes.This article from the case,combined with the current legislation,finds that the selection mechanism has the following questions:the lack of open and scientific selection way;registration,announcement and delivery of materials for a short time;consumer representation is"low proportion,narrow range",and rights relief mechanism is imperfect.At the same time,the article puts forward three reasonable recommendations:improve the selection mechanism of consumers;strengthen the government for the public service concept;give full play to the media to improve the price hearing system,and try to avoid Price hearings run counter to the consumer interests.
