摘　　要：2014~2015年间,发生了狼牙山五壮士名誉侵权案。在案件审理过程中,一些网络舆论和专家学者对维护英雄名誉案胜诉毫无信心,某些部门态度冷漠,不予协助。在法院依法判定被告侵权后,社会上存在质疑判决之声,认为"法院判决是政治判决,不是法律判决",完全忽视了法律的本质。这场诉讼实质上是以法律形式出现的意识形态领域的重大政治斗争,而意识形态斗争法律化,是当前意识形态斗争的一个重要特点。国家应以立法形式捍卫和保护国家英烈的名誉,让侵害英烈权益的人承担必要的法律责任;应将意识形态斗争与法律斗争紧密结合在一起,在意识形态斗争中不断取得胜利,赢取主动,建设具有强大凝聚力和引领力的社会主义意识形态。In 2014 and 2015,defamation against the Five Langyashan Heroes occurred.During the process of the lawsuit against the defamers,some online public opinion and scholars showed no confidence in winning this lawsuit.Some government departments were indifferent and reluctant in providing evidence and cooperation.After the court ruled that the defendant was guilty,some challenged the verdict as“a political one rather than a judicial one,”which completely ignored the essence of the law.This lawsuit is essentially a significant political struggle in the ideological sphere expressed in a legal form.Legalization is an important characteristic of the current ideological struggles.The state should defend and protect the reputation of heroes and martyrs with new legIn 2014 and 2015,defamation against the Five Langyashan Heroes occurred.During the process of the lawsuit against the defamers,some online public opinion and scholars showed no confidence in winning this lawsuit.Some government departments were indifferent and reluctant in providing evidence and cooperation.After the court ruled that the defendant was guilty,some challenged the verdict as“a political one rather than a judicial one,”which completely ignored the essence of the law.This lawsuit is essentially a significant political struggle in the ideological sphere expressed in a legal form.Legalization is an important characteristic of the current ideological struggles.The state should defend and protect the reputation of heroes and martyrs with new legislation that hold infringers liable to legal responsibilities.We must integrate ideological struggles with legal struggles,and keep achieving victories in ideological struggles,win initiative and construct socialist ideology of strong cohesion and guiding power.islation that hold infringers liable to legal responsibilities.We must integrate ideological struggles with legal struggles,and keep achieving victories in ideological struggles,win initiative and construct socialist ideology of strong cohesion and gu
