摘 要:零容忍已经成为当下乃至今后很长时期内我国反腐败政策的重要组成部分,对刑事领域惩治腐败犯罪同样具有重要影响。不应将零容忍确立为惩治腐败犯罪的具体刑事政策,也不应取消腐败犯罪的定罪数额标准。在腐败犯罪的惩治中,零容忍与宽严相济政策具有共通性,二者之间不存在根本性、原则性的冲突。在刑法立法上贯彻零容忍政策,需要通过修正部分犯罪的构成要素以及增设若干罪名的方式完善腐败犯罪的惩治体系。在刑事司法上贯彻零容忍政策,要求适当降低腐败犯罪的成立标准,只要达到犯罪标准的腐败行为都应该作为犯罪予以惩治;对腐败犯罪应严格限制相对不起诉、免予刑罚、缓刑等刑事措施的适用。Zero tolerance has become an important part of our country’s anti-corruption policy for a long-term period,and has also had an important impact on punishing corruption in the criminal field.Zero tolerance should not be established as a specific criminal policy to punish corruption crimes,nor should the criminative amounts of these crimes be abolished.In terms of punishment,zero tolerance and the policy of leniency and strictness are coherent,and there is no fundamental or principle conflict between the two.To implement zero-tolerance policy in the legislation of criminal law,it is necessary to improve the punishment system of corruption crimes by correcting the constituent elements of some crimes and adding a number of crimes as well.The implementation of zero-tolerance policy in criminal justice requires that the standards for the establishment of corruption crimes be lowered properly and that corruption as long as the crime standards are met should be punished as crimes.The application criminal measures such as relative non-prosecution,exemption from punishment,and probation must be strictly restricted for corruption offences.
