摘　　要：公共文化体育设施建设的PPP项目在本质上是实现政府公共服务的社会职能,因此保障公共利益是保证PPP项目正确运行宗旨与根本存在价值的基准。除去政府和社会资本双方外,公众及其组织形态应当成为PPP的利益结构、主体结构和法权结构中不可忽视的一方主体。应当在《基础设施和公共服务领域政府和社会资本合作条例》中进一步实质性地确立、尊重和实现公众参与权中的一系列具体权利,本着公正性、适用性、过程性的原则,健全公众参与公共文化体育设施建设PPP项目的程序机制、救济机制,并使之法制化,促进公共体育PPP项目在内的PPP模式持续健康开展,并发挥对政府主导公共治理协同化以及社会公共服务均等化的积极作用。In the main structure of the public sports PPP project,Except for both the government and the social capital,the public and its organizational form should be the principal part of the PPP s interests structure.Government and social capital cooperation Ordinance in the field of infrastructure and public services is an important administrative rule.We should further establish,respect and realize a series of specific rights in the public participation right in legislation.We should adhere to the three basic principles of fairness,applicability and life cycle in legislation.We should improve the procedural mechanism and relief mechanism of public participation in the construction of PPP projects for public cultural and sports facilities,and make scientific and reasonable provisions in legislation.Therefore,through the public participation to effectively promote public sports PPP project,PPP mode continues healthy development.We should give full play to the positive role of public participation in the government led public governance synergy and promote the equalization of social public services.
