摘　　要：矿业权出让方式的选择是市场和政府在资源配置中发挥作用水平的风向标。本文梳理了矿业权出让方式变化的历史沿革,讨论了市场和政府在配置资源中的优缺点,分析了5种矿业权出让方式的资源配置的理论内涵,总结了国际上对于招标、拍卖、挂牌和申请在先出让矿业权的新变化,指出中外矿业权出让的3个差异决定了中国已经失去了申请在先取得探矿权的前提条件,最后建议加快把当前关于出让方式的规定向全国铺开。The choice of the mining rights remise mode is the vane whether the market or the government allocates the resources.This paper reviews the change of the mining right remise mode in history,discusses the advantages and disadvantages of the market and the government in the allocation of resources,and analyzes theory meaning of resource allocation in 5 kinds of mining rights remise mode,summarizes the new changes in foreign mining rights remise mode including tender,auction,listing and prior apply for registration,and points out 3 differences between China and foreign countries mining rights remised which decide China has lost the premise condition of prior application made prospecting.Finally,the paper proposes to speed up the new rules throughout the country.
