摘　　要：现行环境侵权救济机制对于环境侵权行为规制上存在着大量的客观不能,环境侵权救济与赔偿机制力有不逮,绿色保险的产生正是为解决侵权责任制度中侵权行为法分散损失能力不足的问题。绿色保险以侵权责任为基础,涉及众多影响判定的因素,被保险人的责任认定与侵权责任相关且尤为重要。There exists vast a large number of objective inefficiencies in the regulation of environmental infringement acts.Environmental infringement remedies and compensation mechanisms are incompetent.While the emergence of green insurance is precisely to solve the problem of the incompetency in mitigating the loss in the tort liability system.Green insurance is based on tort liability,involving many factors that influence the decision,and most importantly,the insured’s responsibility should be related to tort liability.
